The Toxic Substances Control Act (TSCA) of 1976 provides EPA with authority to require reporting, record-keeping and testing requirements, and restrictions relating to chemical substances and/or mixtures. Certain substances are generally excluded from TSCA, including, among others, food, drugs, cosmetics and pesticides.

LABOR RIGHTS 

The Uyghur Forced Labor Prevention Act (UFLPA) is a U.S. law.  It established a rebuttable presumption that goods mined, produced, or manufactured wholly or in part in the Xinjiang Uyghur Autonomous Region (XUAR) of China or by an entity on the UFLPA Entity List are subject to import under Section 307 of the Tariff Act of 1930 (19 U.S.C. § 1307).  The law was enacted on December 23, 2021, and enforcement began on June 21, 2022.

DUE DILIGENCE 

On 25 July 2024, the Directive on corporate sustainability due diligence (Directive 2024/1760) entered into force. The aim of this Directive is to foster sustainable and responsible corporate behaviour in companies’ operations and across their global value chains. The new rules will ensure that companies in scope identify and address adverse human rights and environmental impacts of their actions inside and outside Europe.

The law requires companies above a certain size to disclose information on what they see as the risks and opportunities arising from social and environmental issues, and on the impact of their activities on people and the environment. Companies subject to the CSRD have to report according to European Sustainability Reporting Standards (ESRS).
